Terms & Conditions
1. Booking fee
A non-refundable deposit is required to secure the photographer’s services for a specific date.
2. Payment Schedule
A breakdown of how and when the payments are to be made, such as a percentage upfront and the rest upon completion or delivery: 30% advance, 50% at the start of work at the venue, 10% at the end of the work, and the remaining 10% upon final delivery of the photos/videos.
3. Overdue Payments
Consequences for late payment, such as interest charges or the withholding of images.
4. Additional Costs
Any extra expenses that are the client’s responsibility, including travel, permits, or reshoot fees.
5. Booking Confirmation
A photography booking will be considered confirmed only after the required booking fee has been received and the date has been mutually agreed upon.
6. Cancellation & Rescheduling
Any cancellation or request to reschedule a booking should be communicated as early as possible. Rescheduling is subject to the photographer’s availability. Any applicable charges or deposit terms will depend on the circumstances and the agreed booking terms.
7. Photography Coverage & Deliverables
The photography coverage, number of photographs, editing, albums, videos, and other deliverables will depend on the package selected and agreed upon by the client and the photographer.
8. Delivery of Photos
Edited photographs and other agreed deliverables will be provided within the estimated delivery time communicated at the time of booking. Delivery timelines may vary depending on the size and nature of the assignment.
9. Client Cooperation
The client is responsible for providing accurate event details, timings, venue information, and any necessary permissions required for photography. Delays caused by the client or venue may affect the coverage or delivery timeline.
10.Photographer's Portfolio Rights
The photographer may use selected photographs from a photography assignment for portfolio, website, social media, promotional, or marketing purposes, subject to any privacy or usage agreement made with the client.
11. Copyright
All photographs and creative works produced by the photographer remain the intellectual property of the photographer unless otherwise agreed in writing. Clients may use the delivered photographs for personal purposes but may not commercially reproduce or sell them without permission.
12. Unforeseen Circumstances
The photographer will not be held responsible for circumstances beyond reasonable control, including severe weather, natural disasters, venue restrictions, accidents, government restrictions, or other emergencies that may affect the photography service.
13. Equipment & Technical Issues
Reasonable precautions will be taken to protect and preserve photographs. In the unlikely event of equipment failure, technical problems, or loss of data despite reasonable precautions, the photographer’s liability will be limited to the extent permitted by applicable law.
14. Agreement
By confirming a booking with Timeout Gallery, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
15. Data & Image Storage
Data & Image Storage: The photographer will retain the client’s photographs, videos, and other related digital files for a period of two (2) months from the date of delivery. During this period, the client may request the available files in accordance with the agreed deliverables.
After the completion of the two-month storage period, the photographer reserves the right to delete, archive, or otherwise remove the files from their storage systems without prior notice. The photographer does not guarantee the availability, preservation, backup, or recovery of any photographs, videos, or other files after this period.
Any request for retrieval, restoration, or re-delivery of files after the two-month storage period, if the files are still available, may be subject to an additional charge. Such requests will be fulfilled only where the requested files are available and can reasonably be recovered.
Client Responsibility: The client is advised to download and securely maintain their own copies of all delivered photographs, videos, and other files within the applicable storage period. The photographer will not be responsible for the loss or unavailability of files after the stated storage period.
16. Website Content
All photographs, videos, text, graphics, logos, and other content displayed on the Timeout Gallery website are protected by applicable intellectual property laws. Such content may not be copied, reproduced, modified, distributed, or used for commercial purposes without prior written permission from Timeout Gallery.
17. Changes to Terms:
Timeout Gallery reserves the right to update or modify these Terms & Conditions from time to time. Any changes will be effective when the updated Terms & Conditions are published on the website. Clients are encouraged to review these terms periodically.
